You may only request a booking if you agree to these terms and conditions.
By requesting a booking you are deemed to have accepted these terms and conditions as governing your booking.
This does not affect your statutory rights as a consumer
We reserve the right to change these terms and conditions at any time. Any such changes will take effect immediately when posted on the Website, in the brochure or otherwise brought to your attention. It is your responsibility to read the terms and conditions each time you request a booking and any such request shall signify you have accepted to be bound by the latest set of terms and conditions.
1. Booking Confirmation
When you wish to place a booking for a holiday (“Booking Request”) with us, you will complete a booking form (either on the website, over the phone, by email,). It is your responsibility to provide us with the correct information. If you have made the Booking Request via telephone, we will read back your details to you. You will be responsible for the Booking regarding any input errors.
For all Booking Requests we process, we shall issue written confirmation accepting your booking request with a booking reference number.
Once Forest Holiday Cottages has issued such written or email confirmation it shall have entered into a contract with you.
By making a Booking Request you warrant that you have the authority of all persons in your party to book on their behalf, accept these terms and conditions and that you will indemnify Forest Holiday Cottages and keep Forest Holiday Cottages fully and effectively indemnified against all loss and damage arising directly or indirectly, from any act or default by yourself or any person or animal accompanying you.
Bookings are not transferable.
In addition to these terms and conditions, there may be specific rules and regulations which apply to individual sites. These will, where applicable, be prominently displayed in the reception area of each site.
2. Services, Features and Facilities
Forest Holiday Cottages take no responsibility for injury, damage or loss caused by any activity participated in on our sites. Many of the facilities and services referred to in the brochure or on the website are run by third parties and not Forest Holiday Cottages. Where facilities and services are supplied by Forest Holiday Cottages, all safety instructions must be followed and safety equipment worn as appropriate to the activity. Where disclaimer forms are appropriate, these must be signed before participating in the activity.
Information about features, facilities and services for your holiday Cottage, is, to the best of our knowledge and belief, accurate at the time of publication of the brochure and Website, All facilities and services are subject to availability.
Diagrams and photographs on our Website and in the brochure are intended to illustrate the level and type of accommodation which is available. While these are substantially accurate, there may be some variations in individual cases.
As our cottages are located in a forest environment, we cannot accept responsibility for any damage, injury or inconvenience caused by wildlife.
3. Management
Empowerment for all aspects of site operational management lies with the Site Managers. Forest Holiday Cottages fully supports its Site
Managers in dealing with matters of policy at their sole discretion when the need arises. In placing a Booking Request you agree that you and your party will at all times comply with any policies or rules specific to the cabin site or any reasonable instructions or requests of the Site Managers.
4. Payment
We will request a deposit of 10% per cabin per week plus a card deposit of £200.00 taken for any breakages. The balance of the full payment will be due 2 weeks prior to the start date of your holiday. For all bookings received within 2 weeks of your holiday start date, full payment is due at the time of booking. Non-receipt of the full accommodation charge by the due date will be treated by us as a cancellation of the booking and you will forfeit the total cost of any payments made to date. The booking will then be subject to the cancellation procedure outlined in Condition 5.
Payment for bookings can be made by Debit or Credit Card. Please note that payments made by Credit or Charge Card are subject to a non refundable additional charge of a minimum of 3% of the total amount due. Payment by this method confirms that you accept this additional charge. Cheques can only be accepted at least 15 days prior to the start of your holiday.
5. Cancellation
If you want to cancel your booking you must notify us as soon as possible and confirm in writing. Provided the cancellation is received not less than 12 weeks before the start date of the holiday, only the deposit will be forfeited. If we receive less than 2 weeks notice, you will be liable to pay the total cost of the holiday.
Our customers visit our sites to enjoy the peace and tranquility of the forest. If anyone does not respect this, the Site Manager reserves the right to refuse them admission or ask them to leave the site at any time. If you are asked to leave under these circumstances, no monies will be refunded.
In the unlikely event that Forest Holiday Cottages have to change or cancel your holiday:
Changes to holidays
Occasionally we have to make changes to bookings. Whist we endeavour to avoid making changes, we reserve the right to do so and no compensation is available.
i. Changes to accommodation.
If the level of accommodation booked is unavailable, we will in the first instance endeavour to upgrade your accommodation at no extra charge to you. Where higher grade accommodation is unavailable, we will accommodate your party in the next available grade and refund the subsequent difference in cost.
ii. Changes in date
If the date of the booking is unavailable, we reserve the right to move your holiday by up to three days earlier or later than the start date of the holiday booked.
Cancellations by Forest Holidays
We reserve the right to cancel your holiday. In the unlikely event of us having to cancel your holiday (except where you have failed to make full payment on time) we will offer you the choice of a full refund of all monies paid to us or the option of re-booking your holiday at a comparable standard (with you paying any additional cost or receiving a refund in respect to the price difference). No compensation is available. Forest Holiday Cottages Ltd have the right to cancel a customers booking due to circumstances out of our control, but would refund a customers money.
6. Amendments
If you want to amend your booking you must notify us as soon as possible. Amendments to your booking can be made up to 12 weeks prior to the start date of your holiday and are subject to availability and to a £20 administration fee. All amendments are subject to availability. Should you wish to transfer your booking to another location and/or date, we will use our reasonable endeavours to satisfy your request wherever possible, but shall be under no obligation to do so.
7. Pricing
Cottage pricing is calculated across date ranges. If your holiday falls within two (or more) price bands, the corresponding price for each date range will be charged. Prices include VAT at the current prevailing rate where applicable. Whilst we will make every effort to ensure that our prices remain unchanged, they may be amended at any time prior to payment of the final balance. In such circumstances, you may cancel your booking by giving notice in writing, by Recorded Delivery, within 14 days of the issue date printed on your invoice, and we will refund all monies paid in respect of the booking.
8. Occupants
The maximum number of people occupying your accommodation must not exceed the number shown in the particulars of the cottage.
We do not accept bookings for Stag or Hen nights, all male or an all female groups. It is essential that you and your party will at all times comply with any policies or rules specific to the cabin site or any reasonable instructions or requests of the Owners.
9. Pets & Smoking
No Pets allowed, anyone found smoking or having pets will be asked to leave and charged £150.00
10. Arrival and Departure
Arrival time on site is 2pm on the agreed date of arrival. If you are likely to arrive late, please let the Site Manager know. Please note that arrival may be accommodated from 2pm Please contact the site directly 7 days before your arrival date if you wish to organise an early arrival.
Your booking ends at 11am on your agreed date of departure. A late departure (up to 5pm) may be arranged (subject to availability). at a cost of £30.00
11. Your Responsibility
The accommodation must be left in a clean and tidy condition. Please make our Site Manager aware of any breakages or damage caused during your stay. Forest Holiday Cottages shall be entitled to charge you for any costs or expenses it incurs as a result of any breakage or damage or a failure by you to leave the accommodation in a clean and tidy condition.
You are responsible for the behaviour of all members of your party. Please show consideration to other guests, Forest Holiday Cottages staff and our site. Noisy or disruptive behaviour, especially at night, wilful damage to the site or cabins or other behaviour considered by Forest Holidays staff to be inappropriate may result in us asking you or a member of your party to leave the site immediately. No refunds or compensation will be given in these instances, and we reserve the right to claim compensation for damages or inconvenience caused.
Children remain the responsibility of their parents or guardians at all times in the cabins, on the site and during activities. Please ensure your children are supervised at all times.
12. Cancellation and breakage cover
A £200 deposit will be taken on site to cover any damage to the cabin, its contents and the site.
13. Complaints
We are most concerned that you have an enjoyable holiday.
Should you nevertheless have cause for complaint, please contact our Site Manager immediately who will advise you of our complaints procedure.
14. Force Majeure
Forest Holiday Cottages cannot accept responsibility for any holiday where it is affected or prevented by reason of circumstances that amount to force majeure. ‘Force Majeure’ means any event which Forest Holidays or any associated supplier could not, even with all due care, have foreseen or avoided. Such circumstances include war, threat of war, riot, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, foot and mouth disease and all other similar events outside of our control.
15. Disclosure
By agreeing to these terms and conditions you are agreeing to abide by all of our site policies which are available at all of our sites.
16 Liability
Unless required by law, we will not be liable to you for any loss of profit, loss of business or loss of goodwill or for any indirect or consequential losses whatsoever and our maximum liability shall be no more than to refund the amount paid by you for the holiday.
We shall have no liability to you for any failure to perform any of our obligations under the contract if and to the extent that the failure is caused by act of God, governmental restriction, condition or control or by reason of any act done or not done pursuant to trade dispute, shortages of labour or materials or breakdown of machinery or any other matter (whether or not similar to the foregoing) outside of our control.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any right you may have as a consumer under local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
17. Third Party Rights
No person (except you and us) shall have any rights pursuant to the Contract (Rights of Third Parties) Act 1999 (the “Act”) to enforce any of these terms and conditions. Any right or remedy of a third party which exists or is available apart from the Act is not affected.
18. Governing Law
These terms and conditions shall be governed and interpreted exclusively according to the laws of England or Scotland, whichever are appropriate. We and you agree to submit to the exclusive jurisdiction of the English or Scottish Courts in relation to any matters of dispute arising out of or in connection with these conditions provided that we may, at our option, take proceedings in the courts of the state or country in which you are domiciled including action to obtain any remedy (including injunctive relief).
